Newly minted Gov. Ron DeSantis has indicated he may drop the state’s appeal of a court decision that said a Florida law banning patients from smoking medical marijuana is unconstitutional.

A federal appeals court Thursday rejected a constitutional challenge to a Palm Beach County School Board policy requiring substitute-teacher applicants to take drug tests.

In a closely watched case, an appeals court this week agreed to put on hold a circuit judge’s ruling that said Florida lawmakers and the state Department of Health have violated a 2016 constitutional amendment that broadly legalized medical marijuana.

An appeals court Tuesday rejected a request to quickly send a major medical-marijuana case to the Florida Supreme Court.

The case focuses on arguments about whether a 2017 law improperly bars patients from smoking medical marijuana.

Leon County Circuit Judge Karen Gievers last month ruled that the smoking ban violated a 2016 constitutional amendment that broadly legalized medical marijuana in Florida.
