Senators Unveil Legislation To Protect Patients Against Surprise Medical Bills

With frustration growing among Americans who are being charged exorbitant prices for medical treatment, a bipartisan group of senators Tuesday unveiled a plan to protect patients from surprise bills and high charges from hospitals or doctors who are not in their insurance networks.

A doctor offers a surgical add-on that leads to a $1,877 bill for a young girl's ear piercing. A patient protests unnecessary scans to identify and treat her breast cysts. A study shows intensive care-level treatment is overused.

ProPublica has been documenting the myriad ways the health system wastes money on unnecessary services, often shifting the costs to consumers. But there are ways patients can protect themselves.

Because of a new law, Florida patients won’t have to pay for medical care by doctors outside their insurance network if the service was performed at an in-network hospital.

The law effectively bans a practice called “balance billing.” But emergency room doctors say the new law misses the mark.

A consumer health measure aimed at protecting insured patients from surprise bills was filed Thursday by state Sen. Rene Garcia, R-Hialeah.  

 

Florida legislators have been grappling with the problem of balance billing—also known as “surprise billing”—and now the Center for Medicare and Medicaid Services has proposed a broader rule aimed at fixing the issue.
