The state Agency for Health Care Administration faces a legal challenge because of decisions about the addition of a nursing home in Northwest Florida. 

PruittHealth-Okaloosa County, LLC is challenging a preliminary decision last month by the agency to deny a certificate of need for a PruittHealth plan to build an 84-bed nursing home in Okaloosa County, according to documents filed last week in the state Division of Administrative Hearings.

PruittHealth also is challenging a decision by the agency to give preliminary approval to a certificate of need for an 84-bed Okaloosa County nursing home proposed by JDM Health Services, LLC.

The certificate of need, or CON, process requires the state to sign off before new nursing homes can be built. Lawmakers this year eliminated the process for new hospitals but kept it for nursing homes.
