Tobacco Industry Takes Hit In Punitive Damages Ruling

In a defeat for the tobacco industry, the Florida Supreme Court on Thursday opened cigarette makers to more potential punitive damages in lawsuits stemming from smokers' illnesses or deaths.

A $100 million settlement has been reached between three major tobacco companies and hundreds of people who sued them for smoking-related deaths and illnesses in Florida federal court.

The tentative agreement announced Wednesday involves R.J. Reynolds Tobacco Co., Philip Morris USA Inc. and Lorillard Tobacco Co. The deal resolves about 400 cases pending before a federal judge in Jacksonville, but does not affect thousands of other lawsuits pending in Florida state courts.

America's biggest tobacco companies say they are ready and willing to pass along factual public health information about cigarettes.

But they say they will not go along with being forced to underwrite an ad campaign that would have the companies brand themselves as liars.
