A jury has failed to reach a verdict on the first day of deliberations in the Medicare fraud trial of a prominent Florida eye doctor who is accused separately of bribing a U.S. senator.

Federal prosecutors argued Tuesday that a prominent Florida eye doctor tied to alleged political corruption ran a practice that was actually a well-organized scam that stole millions from Medicare.

A federal prosecutor charged that a prominent Florida eye doctor tied to a U.S. senator's alleged corruption built much of his fortune by defrauding Medicare and instilling false hopes in his patients.

Prosecutor Carolyn Bell said during opening statements Thursday at Dr. Salomon Melgen's Medicare fraud trial that he stole millions by falsely diagnosing patients and by performing unnecessary tests and treatments.

Melgin attorney Matt Menchel countered in his opening by saying Melgen aggressively treated patients and made mistakes, but wasn't a criminal.

A Florida doctor charged with corruption alongside New Jersey Sen. Bob Menendez appeared closer to being released from jail Monday as an agreement about his bond solidified.

A hearing in federal court in West Palm Beach ended with no formal decision on Dr. Salomon Melgen's release, but U.S. Magistrate Judge James Hopkins said he hoped to issue an order Wednesday in the Medicare fraud case.

Hopkins ruled last month that Melgen should be held until he stands trial in the Medicare case, which is separate from corruption charges he faces with Menendez in New Jersey.

A federal judge pressed for further details Monday on the foreign assets of a Florida doctor charged with corruption alongside New Jersey Sen. Bob Menendez, putting off a decision on his bond after nearly eight weeks behind bars.

U.S. Magistrate Judge James Hopkins said he needed to know the value of properties and bank accounts held by Dr. Salomon Melgen in his native Dominican Republic before determining an appropriate bond.

A high-powered Miami attorney and Washington lawyer will now help North Palm Beach ophthalmologist Dr. Salomon Melgen fight federal fraud charges, the Palm Beach Post reports.  

U.S. District Judge Kenneth Marra allowed Melgen to dismiss his original legal team representing him in the $105 million Medicare fraud case, which includes 46 charges of health care fraud and 30 related offenses, according to the Post.

His attorney says Tuesday’s raid is payback for a lawsuit the doctor filed against U.S. Department of Health and Human Services.
